The lawyer for a police officer on trial for allegedly fracturing a man's jaw during
an arrest has told a Perth jury to dismiss the alleged victim's evidence due to inconsistencies
in his story.
ADAM HIKATAREWA WIRINGI is on trial charged with grievous bodily harm after allegedly
throwing DAVID AARON JACOB BARNARD to the ground in February 2007.
The court heard that police saw Mr BARNARD riding a BMX bicycle without a helmet and
told him to stop, but he sped off.
Mr BARNARD was eventually apprehended by police but claimed that during his arrest
he was thrown to the ground head first.
WIRINGI says Mr BARNARD tripped or fell to the ground, and his lawyer KAREN VERNON
said her client hadn't used excessive force on him, but was just doing his job of trying
to arrest Mr BARNARD.
Mr BARNARD admitted to inconsistencies in his evidence, which included telling Swan
District Hospital staff he'd been "beaten up by Aboriginals" the night before.

CANBERRA, April 5 AAP - Foreign Minister Kevin Rudd is entitled to his opinion on factional
thuggery in the Labor party but Assistant Treasurer Bill Shorten denies intimidation is
a problem in the ranks.
Mr Rudd caused a stir on Monday when he told a television audience about the division
in Labor's Cabinet caucus over his emissions trading scheme (ETS) plans, saying he was
urged by some to abandon it but would not say who.
The former prime minister went on to say his party was fundamentally failing because
factional leaders intimidate many in the party, preventing it from being politically effective.
"When the Labor Party is at its best, it's putting the nation first and the party last,"
Mr Rudd told ABC Television on Monday.
"The Labor Party at its best is putting its members first, as opposed to factional
thugsters first."
Mr Shorten, a member of the ALP's powerful Victorian right faction, who helped back
Julia Gillard into the prime ministership last year, did not answer a direct question
on Tuesday as to whether he thought Mr Rudd was referring to him.
He said all political parties had factions, pointing to a recent difference of opinion
between Australian Greens leader Bob Brown and that party's Senator-elect Lee Rhiannon
on Israeli boycotts.
"I think that the Labor Party has functioned pretty well for 120-plus years," he said.
"I think that people can say their mind. I do believe that the Labor party can always
do things better."
Mr Rudd had done nothing wrong by revealing cabinet divisions over the ETS.
"I think he's entitled to his opinion. He's stated it," Mr Shorten said.
"I welcome his contribution."
The former prime minister was doing a very good job as foreign minister, Mr Shorten added.

SA:Aboriginal man survived major trauma

ADELAIDE, Dec 15 AAP - An Aboriginal man who lived about 1000 years ago survived a
life-threatening fall and went on to live for many years in a case that has amazed scientists.
The man, aged about 50 when he died, suffered multiple leg and arm fractures and lost
a large amount of blood in what was probably a fall of several metres from a tree or cliff.
Given the level of care and medical knowledge available at the time, such injuries
should have claimed his life.
But recent studies of his skeleton, which was found in a single burial site in Adelaide
in 1920, have revealed he not only recovered from his injuries but suggested he, and those
caring for him, expected him to.
In a report published in the latest ANZ Journal of Surgery, surgeons Brian Cornish
and associate professor Lucian Solomon and indigenous archaeologist Keryn Walshe said
the man's injuries were severe.
He would have suffered initially from shock, blood loss and pain and later from pressure
ulcers and the risk of infections.
They said the fact that he survived, and lived on for years, could only be the result
of his outstanding fitness and the standard of care he received.
"This is the remarkable thing about this case," Professor Solomon said.
"These days, surviving multi-trauma is strongly associated with emergent resuscitation
and treatment in modern medical facilities.
"Multi-trauma survival before the advent of modern medicine is likely to have been
extremely uncommon, particularly in primitive societies."
Prof Solomon said the man's survival reflected an impressive depth of nursing and social
support in a community of hunter-gatherers.
It also raised questions about the use of very effective herbal medicines and sedatives
to control infections and ease pain.
The report said the sustained diligence required in the man's level of care also suggested
those caring for him had an expectation of success and were evidence of the prevailing
support mechanisms in his community.
As his injuries healed he was left with deformities to both his arm and leg, affecting
his ability to walk and severely limiting his ability to hunt or gather.
The fact that he appeared to have lived for years after the incident, demonstrated
his community's ability to care and provide for such individuals.

FED: Aviation authorities investigate near collision over NT
CANBERRA, Dec 28 AAP - Aviation safety authorities are investigating how two passenger
planes wound up on a collision course over the Northern Territory on Tuesday.
The two commercial flights were travelling on the same flight path and headed for one
another before the situation was corrected early on Tuesday morning.
A mid-air collision was only avoided after the crew of an Airbus A330, travelling south
to Melbourne from Hong Kong, questioned the air traffic controller, who confirmed there
had been a breakdown of separation standards.
A Boeing 737 was simultaneously headed north from Melbourne at the same height level
of 37,000 feet.
The Airbus was told to climb an extra 1,000 feet and divert its path slightly.
The Australian Transport Safety Bureau said the incident was serious and will prepare a report.
A bureau spokesman told AAP it was unlikely the planes had been close to colliding,
given neither of their automatic warning systems had been activated.
A final report should be completed by April, he said.

Prime Minister KEVIN RUDD'S popularity has lifted .. while Opposition Leader MALCOLM
TURNBULL'S support has slumped .. the latest Newspoll shows.
Support for Mr RUDD as preferred prime minister climbed two percentage points to 67
per cent since the last poll .. while Mr TURNBULL'S support dropped two points 18 per
cent.
The poll .. taken at the weekend and published in The Australian newspaper today ..
shows 68 per cent of voters are satisfied with Mr RUDD'S performance .. up from 63 per
cent .. while just 21 per cent of voters say they're dissatisfied .. down from 26 per
cent.
In contrast .. satisfaction with Mr TURNBULL'S performance dropped from 42 per cent
to 39 per cent .. and dissatisfaction rose from 40 to 42 per cent.
Meanwhile .. Labor has increased its two-party preferred lead over the Coalition ..
58 per cent to 42 per cent.
The poll also shows almost sixty per cent of Australians believe a bid by Chinese state-owned
Chinalco .. to increase its stake in Rio Tinto .. should be blocked.

The federal government says it'll create a new body .. to administer water allocations
it buys from the Murray-Darling Basin to replenish the depleted river system.
Water and Climate Change Minister PENNY WONG has announced details of a 12.9 billion
dollar plan .. to secure water in rural and urban Australia over the next decade.
Senator WONG says the government will invest in infrastructure projects to improve
efficiency and to return water to the rivers.
She says the purchased water will be held by a new body called the Commonwealth Environmental
Water Holder.
And the minister says the government will ensure the three billion dollars .. set aside
to buy back water from irrigators in the basin .. is spent on securing water for healthy
rivers in the form of water entitlements.

NSW: Fat babies may risk cot death
SYDNEY, Aug 19 AAP - Fat babies could be at higher risk of Sudden Infant Death Syndrome
(SIDS) because their extra body weight makes breathing and movement more difficult, a
top pathologist says.
Professor Roger Byard from the University of Adelaide has highlighted the risks of
maternal obesity in a recent health journal publication, News Ltd newspapers report.
"We are getting more obese mothers and we are getting more obese babies and infants,"
Prof Byard told The Sunday Telegraph.
"I am not saying all obese babies are going to die but there may be a link to SIDS.
"Is it possible that markedly obese infants may be less able to move from the prone
position, may have upper airway narrowing and may have abnormal pulmonary function? All
of these factors have been linked with an increased risk of SIDS."
Prof Byard will present his work to an international medical conference in Europe in December.

BRISBANE, April 3 AAP - The parents of a Queensland woman who went missing after giving
birth to her fifth child will make a public appeal today for information on her disappearance.
Belinda Martin was last seen at 8.20am (AEST) on Saturday at the Bundaberg Base Hospital.
The 30-year-old, from Bundaberg, had given birth to her fifth child two days before.
Police said Ms Martin left the hospital without her newborn child and concerns were
held for her safety and welfare as her disappearance was out of character.
Searches of the local area have so far found nothing.
Ms Martin's parents have travelled from NSW to make a public plea this afternoon.
Ms Martin was described as being of slim build, 160cm tall, with fair skin and brown
shoulder length hair and brown eyes.
She was last seen wearing a green shirt, dark coloured trousers and no shoes.

Wildlife rescuers hold grave fears for a large koala population in the Pilliga Nature
Reserve in central NSW .. where bushfires continue to rage out of control.
Officials fear up to hundreds of koalas could have already died.
A rescue team of a veterinarian .. a veterinary nurse and a koala handler .. from Sydney's
Taronga Zoo .. have arrived on the scene.
They say a specialist team managed to rescue only two koalas .. when a fire burnt through
the area several years ago.
No injured koalas have been presented to the team so far.

Queensland Premier PETER BEATTIE has set a two week deadline to solve an ongoing industrial
dispute with visiting medical officers.
Mr BEATTIE met with VMOs for the first time today as 95 officers threaten to quit public
hospitals across the state in frustration over pay and working conditions.
Australian Medical Association Queensland president Dr STEVE HAMBLETON says while there
is no firm agreement, Mr BEATTIE is willing to act in good faith to resolve the dispute.
Dr HAMBLETON says Mr BEATTIE wants to get a good outcome within two weeks.
He says VMOs want a four per cent pay rise.
Mr BEATTIE says both sides must have goodwill and be willing to compromise.

The Maine CWRP is a partnership of businesses and environmental organizations working with government agencies to help restore Maine's critically important wetlands and other aquatic resources. On average, every $1 of corporate contribution will bring to a project up to $3 in federal matching monies.
At the ceremony held earlier this month at the Wells National Estuarine Research Reserve in Wells, Maine, Coastal America also recognized George A. (Gus) McLachlan, Maritimes environmental engineer, for his contributions to the Maine Coastal Wetland Restoration Partnership Team. As part of the team, McLachlan received Coastal America's Partnership Award and a letter from President George W. Bush commending his efforts to preserve coastal watersheds.

JAKARTA, July 25 Asia Pulse - Internet giant Google is planning to expand its presence in Indonesia, starting with the opening of an office here this year, officials said last weekend.
Yopie Hidayat, the vice presidential spokesman, said the business would be similar to what Google did in China, where it helped connect small- and medium-sized enterprises to buyers in the rest of the world.
They said they would open an office hereideally before 2012, Yopie told reporters after Vice President Boedino's meeting with Google chief Eric Schmidt.
According to Yopie, the investment would involve setting up a network with local companies that would benefit from the trading efficiency provided by digital connectivity.
Schmidt declined to elaborate on the details of what business Google was specifically interested in expanding in Indonesia, saying only that negotiations with the government were ongoing.
He said, however, the increasing Internet and mobile penetration in Southeast Asia's largest economy, along with the high use of its search engine, made Indonesia interesting to Google.
Schmidt also said he saw an opportunity in the problems posed by the country's large and scattered land area.
The best way to solve the isolation of the islands is to get them connected to the Internet, he was quoted as saying by the newspaper Jakarta Globe.

NEW YORK--(BUSINESS WIRE) - Apr. 13, 2011-- Mergers and acquisitions will remain strong in 2011 because of an abundance of attractive targets and valuation, Bloomberg Tradebook executives said today, revealing the results of a survey of leading institutional investors.
More than 150 buy-side and sell-side executives attended Bloomberg Tradebook's conference, "Mergers & Acquisition Outlook in the New Economy," held at Bloomberg LP's headquarters in New York, where the poll was conducted.
"Mergers and acquisitions continue to increase," said Ray Tierney, Bloomberg Tradebook's President and Chief Executive Officer. "We have seen a jump of more than 115 per cent in M&A trading in just the first quarter of this year."
The abundance of attractive targets and valuations will be the primary drivers of M&A activity in 2011, according to 35 per cent of those surveyed. Other key factors include increasing competition (19 per cent) and the difficulty/ease of securing deal financing (15 per cent).
Other Bloomberg Tradebook survey questions included:
* Who will take over the New York Stock Exchange (NYX) - Of those surveyed, 48 per cent said Deutsche Boerse, 24 per cent said Nasdaq OMX and ICE and 28 per cent said neither.
* What do you expect to be the major source of capital for M&A deal financing in 2011? Equity financing (22 per cent), Debt financing (34 per cent) and Internal cash reserves (42 per cent)
* Are you looking for technology to improve your execution of merger arbitrage and pair strategies? Of those polled, 65 per cent said yes, 12 per cent said somewhat and 21 per cent said no.
* Do you have access to research that helps them recognize and take advantage of M&A opportunities? Of those surveyed, 63 per cent said no or somewhat, while 36 per cent said yes.

Investigators at Swinburne University publish new data on vehicle technology.(Report)
"The IEEE 802.16 standard is a promising technology for the fourth-generation mobile networks and is being actively promoted by the Worldwide Interoperability for Microwave Access (WiMAX) Forum: an industry-led consortium. Among the various service classes supported in the standard, best-effort service is expected to be the major service class subscribed to by users due to its operational simplicity and lower charging rate compared with other service classes," researchers in Hawthorn, Australia report.
"In this paper, we investigate the throughput and packet-access-delay performance of best-effort service using the contention-based bandwidth request mechanism in a saturated IEEE 802.16 network. In particular, we develop a simple fixed-point analysis to approximate the failure probability of a bandwidth request and derive analytical expressions for network throughput and packet access delay. Furthermore, the uniqueness of the fixed point is established. The accuracy of the analytical model is validated by comparison with simulation over a wide range of operating conditions. The implications of various different parameter configurations on the system performance are investigated using the analytical model," wrote H.L. Vu and colleagues, Swinburne University.
The researchers concluded: "The utility of the model is further demonstrated by finding the maximum achievable throughput and obtaining its corresponding optimal initial contention window."

Former Salomon Brothers Technologist Joins Dow Jones Markets.
NEW YORK--(BUSINESS WIRE)--July 8, 1997--Dow Jones Markets announced today that it has named Emily H. Susskind as its new senior vice president, technology, effective immediately. She will be responsible for Dow Jones Markets' technology development worldwide, including the implementation and integration of new technologies.
Ms. Susskind's appointment rounds out the formation of Dow Jones Markets' new senior executive team. Five of the eight senior managers have joined Dow Jones Markets within the last 18 months. The other three have new responsibilities.
Ms. Susskind, 42, has 20 years of experience in systems management, development, design and integration. She was most recently senior vice president, systems development for Tele-TV Systems L.P., a new media and technology joint venture of Bell Atlantic, Nynex and Pacific Telesis, where she was responsible for developing a comprehensive digital video services platform.
From 1985 to 1996, she held several senior-level technology positions at Salomon Brothers. In her last position with Salomon, she was the senior executive responsible for managing the firm's global network infrastructure. She held a number of other technology-related senior posts during her 11 years with the firm, introducing strategic solutions for data access and delivery, formulating new desktop systems and Internet strategies, and developing a database management architecture.
Prior to joining Salomon, Ms. Susskind managed technical consulting services for mainframe customers at Martin Marietta's Mathematica Products Group. She received an M.B.A. in finance from The Wharton School, and has a B.A. in philosophy and mathematics from Wellesley College.

Have a Norse day; WAR FOOTING: John Browett, boss of PC World and Currys, expects an invasion from American rival Best Buy.

VIKINGS and public relations don't usually go hand in hand, so Norwayseems an unlikely place to turn for lessons in customer service.
But DSG International, the former Dixons Group and owner of Currys and PCWorld, has to start somewhere.
Dixons became a byword for poor customer service in the Nineties and the groupstill suffers a reputation hangover from those days.
Chief executive John Browett, who has been in the job for five months, thinkshe has found the solution at the company's Norwegian chain Elkjop.
Its five-step approach to dealing with customers that begins with a simple'hello, how can I help you?' is being imported to UK stores to standardise howstaff talk to shoppers.
Elkjop is the biggest of DSG's Scandinavian chains, the jewel in the crown ofthe group, together accounting for three-quarters of the group's profit.
Browett says it was the last place he expected to find a solution to his problem.
'The Viking spirit is still alive and well,' he says.
'In the Nordic business, customer service is ingrained in the managementprocess. It begins with the chief executive and includes the commercialdirector, the human resources director, all the way down the chain.'
While Browett says the UK arm of the company can boast 'large numbers' ofexemplary staff, he concedes it is far from ingrained in the culture.
'I don't think it was even bolted on to the side of the strategy,' saysBrowett, who quit last year as head of Tesco's online business to run thetroubled electrical retailer. 'Management just didn't take responsibility for it.
For them, it was all about product and price.' In-store training programmeswill be held over the coming months, providing staff with up to a week oftuition.
In future, team bonuses will also include an individual payment based on avariety of measures including sales, customer satisfaction and the results ofmystery shopping tests.
Customers should start to feel the benefit by Christmas, while the full effectswill take two or three years to filter through, Browett says.
He was appointed last year amid increasing concerns.
The UK business was not growing as quickly as it should, hampered by aproliferation of internet retailers nibbling at the edges of its business.
It also faced problems at some of its overseas operations.
But Browett's plans left the City unimpressed last week.
He said he would close 77 Currys.digital stores as leases expire, but that wasless radical than had been expected - particularly as American giant Best
Buy, which recently gave the green light to a joint venture to sell electricalgoods with The Carphone Warehouse, appears to be waiting to pounce on any signsof weakness.
Instead, Browett outlined a gradual programme of change led by betterlookingstores, more choice and improved service.
He plans to open Currys' biggest megastore to date - its location is a closelyguarded secret - countering a plan by Best Buy to open large stores in Britainnext year.
Browett will also expand ranges by almost 15 per cent in PC World stores and 75per cent in Currys through better use of space. He is also urgently reviewingperformance of its offshoots, including DSG operations in Italy and Spain.
His message is that the core UK business is not broken, but can be better run.But with consumer spending on the wane, this will be a tough time to provehimself right, with or without help from his Viking friends..
